Jurisdiction Reform: Final Report to the Civil Procedure Rule Committee on Amendments to Service Out of the Jurisdiction (3 February 2023)
On 1 October 2022, significant amendments were introduced to CPR Part 6 and Practice Direction 6B, delivering a comprehensive reform of the service out gateways and, consequently, the jurisdiction of the Courts of England and Wales. These changes represent a major development in jurisdiction reform, improving clarity and efficiency in cross-border litigation procedures.
The reform process was led by the Civil Procedure Rule Committee (CPRC) service sub-committee, chaired by 3VB’s Tom Montagu-Smith KC. The sub-committee included distinguished members Mr Justice Chamberlain, Mr Justice Foxton, Mr Justice Miles, John McQuater, Paul Lowenstein KC, and Sam Goodman. Together, they developed and recommended the amendments that reshaped the service out framework.
The CPRC has now published the sub-committee’s written report, which formed the basis for these important procedural updates.
